Saying Goodbye to the Bean’s

Longtime residents Denny & Tery Bean have sold their home to get a little less maintenance. We wish them well at their new home. Chase & Shannon Smith are to be the new residents at 241 Sherry Lane.

Board Vacancy for Secretary

While Tery Bean’s move would have created this vacancy, it has been confirmed she actually resigned back in May of this year. Why the current Board did not announce this to the HOA nor begin the process to fill the vacancy is a mystery. The Original Non-Profit Articles filed with the State require a President, Vice President, and Secretary. There is no promotion of position within the Bylaws or CCR’s. Furthermore, the Texas Constitution under the Business Organizations Codes requires a minimum of 3 directors with at least a President and a Secretary and they cannot be the same person (  https://www.sos.state.tx.us/corp/nonprofitfaqs.shtml#NPC ). So why has the current Board been silent on this?

No Updates on HOA Financials

Even though the CCR’s are clear on providing financial reports under CCR 4.03 (f), none have been provided by Treasurer Young as required or requested. This is also in violation of Texas Law under Business Organizations Code Chapter 22, Subsections 22.352 and 22.354.
